Citation Appeal Procedure

Upon receiving a university citation, you may file a request to have the citation reviewed if you can demonstrate ample justification or mitigating circumstances. All appeals must be filed at the Business Office (106) or Security Office (106A) within five (5) working days of the date on the citation.

To appeal a citation or impoundment, complete a "Citation Appeal" form and include all of the relevant information. If an appeal is not filed within the designated time frame of five (5) working days, then the citation is deemed final.

If you are given notice of outstanding citations, but claim you did not receive the citation, you have five (5) working days from the notice date to file an appeal.

Appeals are reviewed by the Director of Finance & Administration. You will be notified in writing of the decision. If the appeal is granted, no further action will be taken. If the appeal is denied, the fine must be paid or a hold will be placed on your account until such payment is made.

If you are not satisfied with the decision, you may request a hearing before the Parking Appeals Committee. This request can be made by calling 254-519-5719 within five (5) working days of the date the initial decision was rendered.

After a period of ten (10) days from the date of issuance of the citation or from the date of final determination of appealed citation, citations not resolved through the department will be overdue. Overdue citations may subject the permit holder's motor vehicle(s) to impoundment and/or removal of the parking permit(s). Overdue citations may result in restriction of subsequent academic registration and withholding of a student's transcript until such time the obligation is satisfied. Parking and these restricted services may be restored when all overdue citations have been resolved. At the discretion of Texas A & M University-Central Texas, overdue citations may be adjudicated in a court of competent jurisdiction in accordance with Article 51.208 of the Texas Education Code.

APPEALS PROCESS

1. Complete the "Citation Appeal" form that is provided by the the Business Office (106) or Security Office (106A). The form must be filled out completely and legibly.

2. On this form, describe when the incident occurred, where it occurred, how or why it occurred, and any other relevant facts.

3. If an emergency or other extenuating circumstances are presented as cause for appeal, supporting documentation should be attached to the form (e.g., accident reports, medical records, auto repair bills).

4. Explain how your action did not constitute a violation by applying the parking regulation in question to the facts you have discussed.

Citation appeals that do not adhere to this procedure could result in a forfeit of the right to appeal.

Appeal Review

To help assure fairness in the enforcement of parking violations, a two-tiered appeals process has been established to hear appeals of violation notices.

Level I:

Your completed citation appeal form will be reviewed by the Director who may cancel the citation, in part or whole, or refer the individual to Level II of the appeal review.

Level II:

If you are not satisfied with the level I decision, you may have the citation reviewed by the Parking Appeals Committee consisting of one student, one faculty member and one staff member. You may request that your written statement be sent to the committee or request a personal appearance before the committee by calling 254-519-5471 within the five (5) working days of the date the initial decision was rendered. Failure to request a personal appearance or failure to appear at the scheduled hearing will result in the decision being rendered on the basis of the written statement

The decision of the Parking Appeals Committee is binding.

The parking appeals committee uses the following guidelines to reach a decision:

  • Past parking record may be a factor in the decision.
  • Individuals are responsible for knowing and abiding by the parking rules and regulations. Ignorance of the regulations is not an excuse.
  • A parking permit is not a guarantee of a space. Not only is the driver responsible for finding an authorized space, but the lack thereof does not justify a parking violation.
  • The registrant of the vehicle is responsible for any ticket assigned, regardless of who is driving the vehicle at the time of the violation.
  • Students, faculty, and staff must register their vehicles to drive or park on campus. Parking permits must be displayed correctly to be considered valid.

Some Valid Reasons for Appeal

  • There was substantial evidence you did not commit the violation for which the citation was issued.
  • You committed the violation, but circumstances were not under your control, and
  • Prior to being issued a ticket you made some demonstrable attempt to notify Parking Services or Parking Enforcement of the situation.

Some Invalid Reasons for Appeal

  • Parking only for a few minutes
  • Referring to the rules as ridiculous
  • Inclement weather
  • Late for class or meeting
  • Parking lot being full
  • Another person advised me to park there
  • No knowledge a permit was needed to park on campus
